If someone you love died in a California jail or prison, you may be wondering what a case like yours is worth, or whether other families have ever been paid at all. This page collects reported jail death settlements in California, along with jury verdicts, from 2015 through October 2026. Each entry comes from a court record, a county board document or a news report, and each one links to its source.
We are sorry you are here. Below you will find the table, then a plain explanation of why the amounts range from $50,000 to $16 million, what the largest cases have in common, and what this may mean for your family. These are reported results in California cases handled by other lawyers. They are not LaCour results. Every case is different. Past results, including those listed here, do not predict the outcome of any other case.
Reported California jail death settlements and verdicts, 2015–2026
The table lists 46 cases, newest first. We included a case only if a court filing, a government document or a news outlet reported the amount, and only if the person's family or estate brought the case. "Recommended" means the Los Angeles County Claims Board recommended the settlement and we did not find a record of the final Board of Supervisors vote. Amounts are as reported and often include attorney's fees and costs. As of October 2026.

What is not in the table
We left out cases where we could not confirm the amount, the year or that the family brought the case. A few examples: the United States settled the federal side of a family's case over a death at the Adelanto ICE facility in November 2024, but we did not find a reported amount, and the family's case against the private operator, GEO Group, was headed to trial as of August 2026, according to the National Immigration Project. We also did not include serious injury cases where the person survived, class-action jail reform settlements, or deaths during arrests, which appear on our page about police brutality settlements in California. If you know of a reported case we missed, we would like to hear about it.
What is the typical jail death settlement in California?
Across the 46 cases in the table, the middle amount (the median) is about $1.85 million. The smallest is $50,000 and the largest is $16 million. Nine cases reached $5 million or more, and 11 were under $1 million.
Here is how we got those numbers, so you can check them. We used one amount per case. For settlements we used the total reported amount, adding together verified payments from the county and a medical contractor in the same case (for example, $9.5 million for Maurice Monk). For the Matus verdict we used the $5.4 million the county was ordered to pay, not the $13.5 million total award. Where a contractor paid an undisclosed amount, we counted only the disclosed part. If you set aside the six Los Angeles County settlements that were still recommendations, the median of the remaining 40 cases is $1.9 million. A median from 46 public cases is not an average for all California cases: many settlements are never reported, and some are confidential.
For a fuller explanation of value, see our guide on how much a jail death lawsuit is worth.
How to read these numbers: why amounts vary so much
Two families can lose someone in the same jail in the same year and end up with very different results. These are the main reasons.
- The evidence of what staff knew and did. The larger results tend to involve proof that staff saw a serious problem and did not act, such as video, cell-check logs, medical notes or a call for help that went unanswered. In the Riverside case, the jury found a deputy unreasonably ignored an intercom call about a medical emergency, according to KVCR.
- Whether the county itself can be held responsible. Under federal civil-rights law, a county is liable only for its own policies, customs or failure to train. This is often called a Monell claim. In the Orange County Campos trial, the jury cleared the individual jailers but found the county liable for failing to train, according to Prison Legal News.
- Shared fault. Juries can reduce damages if they find the person who died was partly at fault, for example for taking drugs. That happened in both the Matus and Sandoval verdicts.
- Who the person was and who brought the case. Wrongful death damages are about the family's losses. A case brought by young children who lost a parent can look very different from one brought by a parent or a sibling.
- Who pays. Many jails hire private medical companies such as Wellpath, CFMG or Corizon. In the Shasta County case, Wellpath paid $11.1 million of the $12.75 million total, KTVU reported. Contractors and counties often have separate insurance, and some contractor payments stay confidential.
- Timing and risk. Many cases settle before trial. A verdict can be appealed, as the county did in Campos, and appeals add years.
Patterns in the largest California jail death cases
The cases at the top of the table share a few features, based on what the families alleged and what courts and reporters found.
- A medical emergency that staff did not treat. Elisa Serna, Hayden Schuck, David Barefield and Randall Carrier all died after, their families alleged, clear signs of a medical emergency did not lead to hospital care.
- Suicide-watch and mental-health failures. Randall Johnson, Jose Banda Pichardo and Erick DeAnda are examples. The families alleged a person known to be at risk was not watched, was taken off suicide watch, or was denied prescribed psychiatric medication. Our guide on jail suicide wrongful death claims explains these cases.
- Missed or falsified safety checks. Checks that were skipped, or logged but not done, come up again and again, from Monterey County in 2015 to the Pico Rivera station jail in 2022.
- Force during a mental-health crisis. Christopher Zumwalt, Christian Madrigal, Paul Silva and Martin Harrison all died after force or restraint while in crisis or withdrawal.
- Lost or missing evidence. In Schuck, a federal judge sanctioned San Diego County for failing to keep about 55 hours of video outside his cell, KPBS reported. This is why early preservation letters matter.
Some settlements also required changes inside the jail. The 2015 Harrison settlement required registered nurse evaluations at intake, according to CBS San Francisco, and the Schuck settlement included training reforms.
Results by county
If you want more detail on the jail where your family member died, our county guides cover death records, oversight findings and local claims offices:
- San Diego County jail deaths (Schuck, Serna, Silva, Sandoval)
- Los Angeles County jail deaths (Carrier, Gilbert, Loberg and recent Claims Board settlements)
- Riverside County jail deaths (Matus verdict, Zumwalt)
- Santa Rita Jail deaths in Alameda County (Monk, Harrison, Madrigal, Luong)
- West Valley Detention Center deaths in San Bernardino County
- Sacramento County jail deaths
- Deaths in California state prisons (CDCR)
What these results mean for your family
The table shows that families in California do hold counties, the State and jail medical companies responsible, in big counties and small ones. It also shows that the result depends on proof, and proof disappears fast. Video is recorded over. Cell-check logs get "corrected." Witnesses are released or transferred.
The deadlines are also short. A claim against a California county, city or the State for wrongful death must generally be presented in writing within six months of the death (Government Code § 911.2). If you miss it, you can lose your state-law claims, even if the facts are strong. Federal civil-rights claims under 42 U.S.C. § 1983 generally have a two-year limit in California and do not require a claim first. Claims against a private medical contractor have their own deadlines, but the county is usually a defendant too, so the six-month clock still matters. For ICE detention deaths, a claim against the United States goes through the Federal Tort Claims Act, which has its own two-year administrative process. Our guide to the six-month government claim deadline explains each step, and can you sue if someone dies in jail in California explains who can bring a case.
In practical terms:
- Do not sign anything from the county, the jail or a medical company before you talk to a lawyer.
- Request the coroner or medical examiner report, and write down every name, date and phone call.
- Keep letters, voicemails, texts and social media messages from your loved one.
- Talk to a lawyer well before the six-month mark. We send preservation letters for video, cell-check logs and medical records right away.

Frequently asked questions
What is the average jail death settlement in California?
There is no official average, because many settlements are never reported. In the 46 reported California cases we collected from 2015 to 2026, the median was about $1.85 million, with a range from $50,000 to $16 million. Every case is different, and past results do not predict the outcome of any other case.
What is the largest jail death settlement in California?
Among the cases we verified, the largest is the $16 million San Diego County settlement in 2025 over the death of Hayden Schuck, which KPBS reported was believed to be the largest wrongful death settlement in the county's history. The $15 million Elisa Serna settlement (2024) and the $12.75 million Randall Johnson settlement in Shasta County (2023) are next.
Do jail death cases go to trial in California?
Most settle, but some go to a jury. In 2026 a federal jury awarded $13.5 million in a Riverside County jail fentanyl death and found the county 40% responsible, and in 2025 a jury returned a $3.3 million verdict against Orange County, which the county appealed. A verdict can be reduced for shared fault and can be appealed.
Who pays a jail death settlement?
Usually the county, city or State that runs the jail or prison, often through insurance or a risk pool. When a private medical company such as Wellpath or CFMG provided care, it may pay part or most of the settlement. In the Shasta County case, Wellpath paid $11.1 million of $12.75 million.
How long does a jail wrongful death case take?
Many of the cases in our table took three to six years from the death to a settlement or verdict. The first deadline comes much sooner: a government claim must generally be presented within six months of the death to keep state-law claims.
Do the family's lawyers get paid out of the settlement?
Usually yes. Most families hire civil-rights lawyers on a contingency fee, paid from the recovery, and many reported amounts include attorney's fees and costs. In federal civil-rights cases the court can also order the government to pay the family's attorney's fees if the family wins.
Are these LaCour's results?
No. These are reported results in California cases handled by other lawyers, gathered from public sources so families can see what has happened in similar cases. They are not LaCour results and do not predict the outcome of any case.
