If your CX-90, CX-70, CX-5, CX-50, CX-30 or Mazda3 keeps returning to the dealer for the same defect, the Mazda lemon law California owners can use is the Song-Beverly Consumer Warranty Act. When the manufacturer and its dealers cannot fix a defect covered by the factory warranty after a reasonable number of attempts, the manufacturer must buy the vehicle back or replace it.
Mazda's U.S. operations are based in Irvine, and its warranty booklet gives California owners specific instructions: a three-step complaint process, a dispute program called BBB AUTO LINE, and a California address for written notice. This guide explains those instructions, lists documented recalls with NHTSA campaign numbers, including the run of recalls on the 2024 CX-90, summarizes reported cases and covers the deadlines. It is general information as of October 2026, not legal advice, and it does not suggest that Mazda vehicles are generally defective.
How the lemon law applies to a Mazda
Under Civil Code § 1793.2(d)(2), if the manufacturer or its dealers cannot conform a new vehicle to the express warranty after a reasonable number of attempts, the manufacturer must replace it or pay restitution, and the buyer chooses which. Restitution generally covers the price paid, taxes, registration and incidental costs, less a mileage offset for use before the first repair visit for the defect (§ 1793.2(d)(2)(C)). Our lemon law buyback calculator runs the formula.
The Tanner Act presumption in Civil Code § 1793.22(b) applies within 18 months of delivery or 18,000 miles, whichever comes first. It presumes a reasonable number of attempts if a defect likely to cause death or serious bodily injury was subject to repair two or more times, the same defect was subject to repair four or more times, or the vehicle was out of service for repairs more than 30 cumulative days. For the first two routes, you must also have directly notified the manufacturer at least once if the warranty or owner's manual clearly required it, and Mazda's booklet does. A claim can also succeed with fewer attempts, or after 18 months, if the number was reasonable. Civil Code § 1794 adds attorney's fees and costs for a buyer who prevails and a civil penalty of up to two times actual damages for a willful violation.
Mazda warranty terms
Mazda's warranty page lists a New Vehicle Limited Warranty of 36 months or 36,000 miles and a Powertrain Limited Warranty of 60 months or 60,000 miles, whichever comes first. Mazda's 2026 warranty information booklet sets the High Voltage Battery Limited Warranty at 96 months or 100,000 miles, and for the CX-70 PHEV in California and certain other states it covers capacity loss below 70 percent of the original value for 8 years or 100,000 miles. The booklet notes that capacity can be checked under "Battery Health" on the Mazda Connect screen. Check the booklet for your model year.
What Mazda's warranty booklet says about BBB AUTO LINE and notice
The 2026 booklet lays out three steps.
- The dealership. Talk to the service department, then the general manager or owner.
- Mazda North American Operations. Contact the Customer Experience Center at (800) 222-5500, by email, or by mail at 200 Spectrum Center Drive, Suite 100, Irvine, California 92618, with your VIN, mileage and dealer.
- BBB AUTO LINE. A dispute program offered at no cost to you, at 1-800-955-5100. The booklet says the process "normally takes 40 days or less" and that the decision is not binding on you unless you accept it.
The California section asks for written notice, for the lemon law presumptions, to Mazda North American Operations at the Irvine address, "ATTN: Customer Mediation," and says BBB AUTO LINE claims must be filed within six months after the warranty expires. Send that letter by a method you can prove, describing the defect and the repair visits so far.
BBB AUTO LINE is state-certified for Mazda. A June 2025 Department of Consumer Affairs notice lists Mazda among the manufacturers represented by BBB AUTO LINE as a state-certified program. Under Civil Code § 1793.22(c), when a manufacturer maintains a qualified program and gave you written notice of it, you generally must use that program before you can rely on the Tanner Act presumption. You keep the right to sue, and if you reject the decision you can still go to court. The booklet also says that if you seek remedies that are not created by the federal Magnuson-Moss Act or a state lemon law, you are not required to use BBB AUTO LINE first. The portions of the booklet we reviewed describe no binding arbitration agreement, but read the booklet that came with your car. Our guide to lemon law arbitration versus a lawsuit covers the trade-offs.
Mazda recalls you should know
A recall alone does not make a vehicle a lemon, but a recall that matches your symptom can explain your repair history, and a recall repair that does not fix the problem can become part of your claim. NHTSA lists 11 recalls for the 2024 CX-90 alone as of October 2026. This is a selection, not a complete list. Check your VIN at nhtsa.gov/recalls.
| Model years | Issue | NHTSA campaign no. | Source |
|---|---|---|---|
| CX-90 2024 | A worm gear manufacturing flaw can cause a sudden loss of power steering assist. Dealers replace a spring and re-grease the gear (43,454 vehicles). | 24V-022 | NHTSA |
| CX-90 2024, CX-70 2025 | Powertrain and engine control software can turn on warning lights and cause a loss of drive power (31,488 vehicles). | 24V-815 | NHTSA |
| CX-90 PHEV 2024 | A software error can shut down the engine and electric motor unexpectedly, causing loss of drive power (4,252 vehicles). | 23V-719 | NHTSA |
| CX-90 2024 | Automatic emergency braking can falsely detect an object and brake suddenly. | 24V-349 | NHTSA |
| CX-90 2024 | Steering and suspension bolts may be missing or loose, which can cause loss of vehicle control. | 23V-429 | NHTSA |
| Mazda3 2019–2020 | The Smart Brake System can falsely detect an obstacle and stop the car suddenly (35,390 vehicles). | 19V-907 | NHTSA |
| CX-5 and Mazda6 2018–2019, Mazda3 2019 | A powertrain control module software error can stall the engine. | 19V-497 | NHTSA |
Loss of steering assist, loss of drive power and sudden unwanted braking are the kinds of problems that can bring the two-attempt safety rule into play. Our guide to brake, steering and airbag safety defects explains how that rule works. Several CX-90 recalls are software updates, so if warning lights or power loss return after an update, make sure the next repair order says the problem came back.
Reported cases involving Mazda
Most claims settle privately. These are reported results in cases handled by other lawyers, not LaCour results. The two trial results were reported by Mazda's defense counsel.
| Year | Case | Type | What was reported | Source |
|---|---|---|---|---|
| 2025 | Duffy v. Mazda Motor of America (U.S. District Court, Kentucky) | Class settlement | A settlement over alleged Mazda Connect infotainment problems in many 2014–2023 models, with a two-year infotainment warranty extension and reimbursement of certain repair costs up to $1,750 per vehicle. It had preliminary approval in February 2025, with a final hearing set for August 2025. Mazda denied the claims. | CarComplaints.com |
| 2009 | Gray v. Mazda (California bench trial) | Defense judgment | The owner of a 2007 Mazda3 alleged 10 unsuccessful repair attempts. The judge found no violation of Song-Beverly or Magnuson-Moss. | Bowman and Brooke |
| 2003 | Huchro v. Mazda (Orange County jury) | Defense verdict | The owner of a 2001 Miata alleged a stuck fuel door and water leaks. The jury found the defects did not substantially impair the car's use, value or safety. | Bowman and Brooke |
The lesson from the two trials is that the number of visits is not enough on its own. The defect must substantially impair the vehicle's use, value or safety, and the repair orders must show the same problem coming back. For context, the CALPIRG Education Fund's Auto Lemon Index counted 112 California lemon lawsuits against Mazda Motor of America from 2018 through 2021, about one for every 1,571 new vehicles registered, the second-lowest rate among the 19 manufacturers studied. See our page on the most-sued car brands in California. Lawsuit counts reflect many factors and do not show that any vehicle is defective. Every case is different. Past results, including those listed here, do not predict the outcome of any other case.
Building your Mazda repair record
- Get a repair order at every visit with your complaint, the mileage and what was done, including visits where the dealer found nothing.
- Describe the symptom the same way each time ("steering went heavy at low speed," "lost power, warning lights on"), so the visits read as repeat attempts on one defect.
- Record intermittent problems. A dated photo of a warning message or a short video of false braking or a frozen screen helps when the dealer cannot duplicate it.
- Keep recall letters and recall invoices, and note whether the symptom returned after each update.
- Send the written notice the booklet asks for to "Customer Mediation" in Irvine, and keep proof of mailing and any case number from the Customer Experience Center.
- Track days out of service and keep towing and rental receipts.
Deadlines for Mazda claims
Mazda did not appear on the lists of manufacturers reported to have opted in to the new procedures created by AB 1755 and SB 26, in reports by a California lemon law firm in May 2025 and by Consumers for Auto Reliability and Safety in February 2026. The official list can change, so check the Department of Consumer Affairs list. If the new procedures do not apply, the deadline is generally four years under the Commercial Code's warranty statute of limitations, and tolling rules can apply. Do not rely on extra time; call promptly. If Mazda's status changes, our guide to the 2025 lemon law changes explains the shorter deadlines that apply to opted-in brands.
How LaCour handles Mazda lemon law claims
LaCour Trial Lawyers handles California lemon law claims statewide, in English and Spanish, with trial counsel leading each case. When a claim succeeds, the manufacturer pays your attorney's fees and costs. Send your repair orders for a free, confidential review.
Frequently asked questions
Do I have to use BBB AUTO LINE before suing Mazda?
Not to file a lawsuit. But because BBB AUTO LINE is a state-certified program for Mazda, you generally must use it first if you want to rely on the Tanner Act presumption, as long as Mazda gave you written notice of it. You can reject a decision you disagree with and still sue.
Do I have to notify Mazda directly in writing?
For the two-attempt and four-attempt presumptions, yes, because Mazda's booklet asks California owners to send written notice to its Irvine office. A short dated letter describing the unrepaired defect usually covers it. The 30-day out-of-service route does not depend on that notice.
Is my 2024 CX-90 a lemon because of its recalls?
Not by itself. But if your CX-90 kept losing power or steering assist under warranty, or spent more than 30 days in the shop, those facts can support a claim. Keep every recall invoice and repair order.
How long is the Mazda warranty?
Mazda lists 36 months or 36,000 miles for the New Vehicle Limited Warranty and 60 months or 60,000 miles for the powertrain. The 2026 booklet lists 96 months or 100,000 miles for the high-voltage battery.
How long do I have to file a lemon law claim against Mazda?
If Mazda is not on the state's opt-in list, generally four years under the Commercial Code, with tolling rules that can apply. BBB AUTO LINE has its own filing window in the booklet. Call promptly instead of waiting.
